4. The Contractor submitted the programme on 3 January. On 16 January, a routine progress meeting took place in the headquarter office of the Project Manager. The Contractor and the Project Manager discussed the issues in the submitted programme. On 18 January, the Contractor received no response from the Project Manager and the Contractor notified the Project Manager of this. On 31 January, the Project Manager has still not responded, and he emailed the Contractor saying he disagreed with some of the matters in the programme especially the delay foreseen in the programme. The Project Manager did not give further elaboration or reasons. What is the status of the programme submitted on 3 January? • It is accepted because the Project Manager’s failure to respond to the Contractor’s notification means the programme is treated as accepted; • It is accepted if the Contractor has also notified an early warning on the matter under clause 15.1; • It is accepted because the Project Manager’s failure to notify acceptance or non-acceptance within one week of the Contractor’s notification and the programme is treated as accepted by the Project Manager. • It is not accepted because the Project Manager has further two weeks to respond following the receipt of the Contractor’s notification of failure; • It is not accepted because the Project Manager clearly states that he disagrees with the programme and it is the Contractor’s obligation to submit a revised programme according to Cl. 32.1 to satisfy the Project Manager’s comments.
