Laura owed $6500 to Anthony for locating and repairing a
significant leak in her
basement bathroom sink. Anthony finished the work on June 30, at
which time the entire
bill was due. However, by November, Laura had still not paid the
debt she owed to
Anthony.
By this time, Anthony was in urgent need of cash. He contacted
Laura and told her that if
she would pay him $5500, he would release her from her obligation
to pay the remaining
balance of $1000. Laura agreed. She paid him the $5500 and said to
him that the debt
she owed to him had now been paid in full.
One year later, Anthony contacted Laura and demanded that she pay
him the additional
$1000. Laura refused, based upon their previous agreement. Anthony
then sued Laura
for $1000.
